Drunk bus driver’s case delayed another time

The bus driver who drove a school bus drunk had his sentencing hearing delayed again last week.

David Patrick Stack, of Suttor St, Canowindra, has been waiting for eight months to be sentenced.

He pleaded guilty to a high range drink driving charge last November.

This time the sentencing was adjourned because Mr Stack's senior legal representative was not present in the court house.

Magistrate Phil Moon agreed to the delay in the interests of obtaining the fairest result for Mr Stack.

Mr Moon stressed the delays could not be indefinite though.

"He should be able to have the best representation, but the matter has been before the court and this is the fourth occasion."

Local solicitor Luke Clark addressed the court, saying barrister Michael Allan had a better grounding in the facts, and could therefore provide better representation for Mr Stack.

"The defendant is still awaiting sentence and that is no doubt having an effect on him," Mr Clarke said.

"The defendant is no doubt under a great deal of pressure," Mr Moon said.

The police prosecutor also agreed to the further adjournment, noting Mr Stack could be facing a gaol sentence.

Mr Stack was on his regular school run when passengers became concerned at the way Mr Stack was handling the bus.

According to a police statement of facts, the bus was veering on to the wrong side of the road, at times crossing onto dirt on the far side of the road and taking out markers.

When he was pulled over by a local police officer at Canowindra, he had a blood alcohol level of 0.26, Mr Stack asked to continue driving the children home.
